Statement of Partnership Authority Registration:
Filing is optional, but mandatory if partnership intends
to hold real estate in its name. Initial registration is
with the Secretary of State. A certified copy must also
be filed with the clerk of any county in which the partnership
owns real estate. (Section 10-8A-303).

Registration of business name requirements: Registration
is optional. Alabama does not have a fictitious
name statute, but has a trade name statute. A trade
name is essentially a business name other than the
owner’s name. The applicant must register with the
Secretary of State. (Section 8-12-7).

Name requirements: The statute is exhaustive, stating
that the trade name can not be immoral, deceptive,
or scandalous. Please refer directly to the statute.

Registration application requirements: The application
must include the name of the owner(s), business
address of the owner(s), a description of the type of
business the person is or intends to conduct, the date
when the name was first used, a statement that the
owner(s) is the only person with the right to use that
name, three copies or specimens of the mark. The application
must be signed and verified. (Section 8-12-8).
