Statement of Partnership Authority Registration:
Filing is optional, but mandatory if partnership intends
to hold real estate in its name. Initial registration is
with the Secretary of State. A certified copy must also
be filed with the clerk of any county in which the
partnership owns real estate. (Section 56A-303).

Registration of business name requirements: Registration
is optional. Kansas does not have a fictitious
name statute, but has a trade name statute. A trade
name is essentially a business name other than the
owner(s)’s name. The applicant must register with
the Secretary of State.
Business name Registration fee: $40.00
Term of registration: Ten years. (Section 81-215).
Name requirements: None stated in statute.
Registration application requirements: The signed
and verified registration must include the name of
the owner(s), the business address of the owner(s),
a description of the type of business, three copies or
specimens of the trade name, and a statement that the
owner(s) is the exclusive user of the name. (Section
81-213).
