Statement of Partnership Authority Registration:
Filing is optional, but mandatory if partnership intends
to hold real estate in its name. Initial registration is
with the Secretary of State. A certified copy must also

partnership owns real estate. (Section 54-1A-303).
Partnership Authority registration fee: $50.00

Registration of business name requirements: Registration
is optional. New Mexico’s statute is for trade
names which are names used to identify a person’s
business. The applicant must register with the Secretary
of State. (Section 57-3B-5).
Registration fee: $25.00
Term of registration: Ten years. (Section 57-3B-
8).
Name requirements: None stated in statute.
Registration application requirements: The application
must include the type of business, a sworn
statement that the owner(s) is claiming the exclusive
right to use. The owner(s) shall sign the certificate.
